Release of Liability

Birmingham Cruise Club LLC reserves the right to modify these terms or any additional terms. Any term and condition set by Birmingham Cruise Club LLC shall not infringe on any local, state, or federal laws.

Each registering member and their registered family members hereby acknowledge that hazards and risks are inherent when participating in cruise vacations and other activities associated with cruising and travel, including activities and excursions on and off each cruise ship and general travel including flights and driving to and from destinations. The registering member and family members assumes all risks of injuries, damage, loss, or delays that are related, whether directly or indirectly, to the activities Birmingham Cruise Club LLC participates in.  Additionally, the registering member and all registered family members do hereby absolve, release and waive any and all liability, claims or demands against the Birmingham Cruise Club LLC, and its Owners, Trip Coordinators,  Travel Agency, and each and every member thereof which may arise out of or be related to any injury, illness, damage, or pecuniary loss by reason of such membership or activity of or participation in Birmingham Cruise Club LLC.

Birmingham Cruise Club LLC requires all travelers on a cruise vacation associated with our organization to be a registered member or immediate family member (including spouse/partner and children 21 years of age and under) Any adult that is 22 years of age or older is required to have their own membership in order to receive the benefits of Birmingham Cruise Club or to travel on an associated cruise. Any travelers found to be violating these terms will not receive the benefits of traveling with Birmingham Cruise Club LLC. Further, said violating travelers absolve, release and waive any and all liability, claims or demands against the Birmingham Cruise Club LLC, and its Owners, Trip Coordinators,  Travel Agency, and each and every member thereof which may arise out of or be related to any injury, illness, damage, or pecuniary loss by reason of such membership or activity of or participation in Birmingham Cruise Club LLC or travel to and from destinations.

Birmingham Cruise Club LLC will not be responsible for any personal injuries, property damage, loss, delay, or change of itinerary incurred by any tour participant arising out of the act of negligence of any direct or supplemental air carrier, hotel or other persons rendering any of these services, nor will Birmingham Cruise Club LLC be responsible for any injuries, death, damage, loss or delay in any means of the transportation, including bankruptcies, cancellations, schedule changes, strikes, work stoppages, storm or inclement weather, or by any reasons of any event beyond the actual control of Birmingham Cruise Club, or of any agent or supplier or any act of God. All baggage and personal belongings shall at all times remain in the sole custody and control of each trip participant. Such possessions shall be transported at the owner’s sole risk of loss. Baggage and Trip cancellation insurance are highly recommended. The group shall indemnify and hold Birmingham Cruise Club LLC harmless on any claim made by a trip participant. 

Travel Bookings

The registering member and associated family members understand that Birmingham Cruise Club LLC is not a travel or booking agency. Our sole offering is a membership that provides exclusive access to group cruises and other Club-associated events and communications. The registering member and associated family members understand that in order to travel on a Birmingham Cruise Club LLC associated cruise, they will be referred to Middle of the Magic Travel for actual booking services, as Middle of the Magic Travel is the registered travel agency affiliated with Birmingham Cruise Club. The registering member and associated family members grant Middle of the Magic Travel all of the same releases of liability listed on the release of liability section in the terms and conditions.

Middle of the Magic Travel books all vacations directly with each cruise supplier and has the most up-to-date access to all rates, availability, and inventories. All monies paid for pre-trip deposits, balances due, or other fares are paid directly to each cruise line. Birmingham Cruise Club LLC and Middle of the Magic Travel shall not, at any time, hold any monies from members and travelers for travel purposes.  All monies paid to the cruse lines are subject to each individual cruise line’s terms of cancellation and refund. This will be discussed in detail before any booking is completed. Pricing is not guaranteed until a booking is secured with deposit.

Cancellations

All cancellation policies will be discussed with each member prior to booking any vacation. It is the sole responsibility of the booking member to be advised of such policies. Any failure to provide payment by provided deadlines may result in loss of deposits or other monies previously paid. Birmingham Cruise Club LLC and Middle of the Magic Travel are not responsible for any losses due to cancellations and will clearly communicate payment deadlines in advance.

Rules of Conduct

In order to promote goodwill and relaxation during Birmingham Cruise Club activities (meet-up, trips, meetings, etc.) it shall be the duty of the person in charge of such activity or Birmingham Cruise Club LLC leadership to eject from that activity, anyone whose behavior exceeds the bounds of good taste or who participates in illegal acts. Such person shall also be subject to expulsion, without refund, from the Birmingham Cruise Club if deemed necessary by Birmingham Cruise Club ownership.

Additionally, each traveling member is responsible for maintaining appropriate behavior while onboard cruise vessels and while visiting trip destinations when traveling on a Birmingham Cruise Club LLC associated cruise. Behaviors deemed to be generally unacceptable will not be tolerated and can result in removal from the trip and expulsion from Birmingham Cruise Club. Further, each cruise line may impose additional sanctions and punishments as they deem necessary. Birmingham Cruise Club LLC  has no role in determining or negotiating such sanctions and punishments and is not responsible for any losses associated with such decisions made by cruise line officers and officials.

Membership Benefits

Group Cruises – all terms and conditions apply equally to Birmingham Cruise Club group cruises and individual cruises. Birmingham Cruise Club will secure an allotment of rooms on our group cruises. These group allotments will include a discount for double-occupancy cabins. Additional cruise fares, taxes, and fees will be added on for additional travelers within each reservation. From time to time, there may be additional discounts or sales provided by the cruise lines that offer more competitive pricing. Birmingham Cruise Club’s affiliate travel agent partner has full access to these discounts and will always quote the member with the most inexpensive option, when available. Any requests for upgrades or enhancements by the cruising member will come at an additional cost and are not guaranteed.

Each Membership is listed under the name of the Primary Member. At the time of sign-up, you will be asked to provide the name of the Primary Member. Each booking will use this name as a reference. All additional family members will be listed along with the Primary member, but the Primary Member’s name is the name associated with the membership.

*Member Loyalty Program - Every $10 spent on cruise fares (excludes all taxes, fees, excursions, transportation, food & beverage, and on-board purchases) earns 1 loyalty point. Every 1,000 loyalty points earned can be redeemed for a $150 on-board credit on a future cruise. Each cruise must be completed, without cancellation or refund, in order to receive points. On-board credits cannot be applied retroactively to past cruises and can only be applied towards future cruise reservations after enough points have been earned through completed cruises. Loyalty points have no cash value and cannot be redeemed should a member choose to end their membership with Birmingham Cruise Club. In the event that a cruise line does not offer prepaid on-board credits, Birmingham Cruise Club may offer a discount of equal value to the amount of earned credits at the time of final payment for your cruise. On-board credits are not automatically applied to a reservation that qualifies for this benefit. You must let the booking agent know you want to use your loyalty program credit when completing the booking process. Point redemptions cannot be transferred between members. Points are awarded to each membership account, not each person within the membership account.

*Member Referral Program  - As a member of Birmingham Cruise Club, you have the opportunity to receive a reward any time you refer someone to join Birmingham Cruise Club who then completes their first cruise with our program. In order to qualify, the referred member must complete a minimum 3-night cruise with no cancellation or refund. Once completed, the referring member will receive a notification from Birmingham Cruise Club that their reward is now available. The referring member will receive a $50 gift card that will be mailed to their address on file (E-gift card when possible) or a $50 on-board credit towards a future cruise that is booked through the Birmingham Cruise Club program. The referring member will be able to choose from a list of available gift cards at the time the reward is available. These gift cards are typically supplied from large national vendors like Visa, Target, Amazon, Walmart, etc., but are based upon availability. Should the referring member’s first choice of gift card not be available, they will be notified and provided alternate options. Birmingham Cruise Club does not offer cash as a replacement for gift cards or the on-board credit. There is no limit to the number of referral rewards a member can receive. Limit to one reward per Primary Member referred (You do not receive a reward for each member in the referred family. You receive one reward per family referred, or primary member). This reward will be provided by the commissioned Middle of the Magic Travel Agent.

*Cruise Meetups – Birmingham Cruise Club LLC aims to host scheduled meetups in the Birmingham area for our Members. Future meetups will be based on participation, so it is essential to have positive member turnout in order to schedule events. Members are expected to conduct themselves according to the rules of conduct outlined in the terms of conditions when attending Birmingham Cruise Club meetups and events. From time to time, Birmingham Cruise Club LLC may choose to include a gift or benefit (food, giveaways, etc.) during an event or meetup, but this is not guaranteed. For liability purposes, Birmingham Cruise Club LLC will not provide complimentary alcoholic beverages to any members. The locations of Club events and meetups may, at times, provide alcoholic beverages for sale. Members who are of legal drinking age are free to purchase alcoholic beverages, but are responsible for their behavior while consuming such beverages. The rules of conduct in the terms of conditions also apply to circumstances where the service of alcohol is involved.
